The saga surrounding Sean “Diddy” Combs just took another unexpected turn, and this time, it’s raising eyebrows for more than one reason. Currently serving time at a federal facility in New Jersey, the once-dominant music mogul is now at the center of a legal push that’s as controversial as it is headline-grabbing.

Diddy’s attorneys are making a bold argument in hopes of getting him released sooner rather than later, and let’s just say it’s not your typical appeal strategy. During a recent hearing in New York, Diddy’s legal team laid out their case for why he should be freed immediately. Their reasoning? They claim the infamous “freak-off” tapes tied to his conviction weren’t criminal acts at all, but rather a form of protected expression, per Page Six.

According to his lawyers, “Freak-offs and hotel nights were highly choreographed sexual performances involving the use of costumes, role play, and staged lighting, which were filmed so Combs and his girlfriends could watch this amateur pornography later.”

They went even further, arguing, “Pornography production and viewing of this sort is protected by the First Amendment and thus cannot constitutionally be prosecuted.” That’s a pretty massive claim and one that prosecutors were quick to shut down.

Federal officials didn’t mince words, calling the defense’s argument “meritless” and emphasizing that Combs’ situation is far removed from anything resembling a legitimate adult film operation. In their response, they argued, “He hired and transported commercial sex workers to have sex with his girlfriends for his own sexual gratification, sometimes directly participating in the sex acts.”

For context, Diddy was convicted in July 2025 on charges related to transportation for prostitution, following his high-profile arrest in 2024. While he avoided convictions on more serious charges like racketeering and sex trafficking, the counts he was found guilty of still carry significant weight, up to 10 years per count.

At sentencing, Judge Arun Subramanian made it clear that the punishment was no small matter, stating that it would mean “hard time in prison, away from your family, friends and community.” However, he also added a note of eventual hope, saying Combs “will have a life afterward.”

And now, it seems that “afterward” is something his legal team is trying to move up. They’ve requested not only an immediate release from the New Jersey prison, but also a judgment of acquittal or a resentencing altogether. It’s an aggressive move, especially considering how recent the conviction still is.

That said, there have already been some shifts in his timeline. His projected release date was recently moved up slightly to April 2028 after he was accepted into a rehabilitation program. According to a representative, “Mr. Combs is an active participant in the Residential Drug Abuse Program and has taken his rehabilitation process seriously from the start.”

They added, “He is fully engaged in his work, focused on growth and committed to positive change.” Still, it hasn’t been a perfectly smooth road. At one point, his release date was actually pushed back due to alleged rule violations while behind bars. So it’s been a bit of a back-and-forth situation.

“Keep him in jail. This is not a good person,” one online comment read. “He’s learned nothing and has zero remorse,” said another. “Keep that man locked up,” a third person chimed in.

Now, the bigger question is whether this latest legal argument will actually hold any weight. On one hand, it’s certainly attention-grabbing. On the other hand, it’s already facing heavy resistance from prosecutors and likely won’t be an easy sell in court.

At the end of the day, this chapter of Diddy’s New Jersey prison story is far from over. If anything, it feels like things are just heating up again.
