An Oregon family is speaking out after a truly stomach-turning situation inside their home turned into a legal battle, and honestly, it’s the kind of story that’s hard to shake once you hear it.
According to reports out of Oregon, a father named Bryan Padilla has filed a lawsuit against the company that owns his family’s apartment complex, claiming their living conditions led to a disturbing and potentially dangerous incident involving his infant son. The case centers around what allegedly happened inside their Portland unit, and it’s enough to make any parent uneasy.
The family had only recently settled into their Oregon apartment, moving in on November 8 with their 10-month-old baby. Like most new tenants, they were expecting a fresh start. But that didn’t last long. Padilla reportedly began noticing signs of a rodent problem and says he submitted multiple maintenance requests to address it, per Law and Crime.
Oregon Parents Are Furious After Finding Mouse In Baby’s Mouth
That’s where things take a turn. By late December, the issue hadn’t been resolved, and according to the complaint, it escalated in a way no one could have predicted. On December 22, Padilla allegedly found his infant son with a dead mouse in his mouth after it had made its way into the apartment.
The baby was immediately rushed to the emergency room, where doctors thankfully determined there were no serious medical complications. But even with that outcome, the emotional impact is hard to ignore. As Padilla later shared, “I was just livid. I had to leave work right away.”
The family didn’t stick around after that. Within days, they packed up and left, citing unsafe conditions. It’s not just about one incident, it’s about what led up to it and whether it could have been prevented in the first place.
Padilla’s attorney, Michael Fuller, is arguing that the landlord failed to meet basic obligations under the Oregon Residential Landlord Tenant Act. In other words, the claim is that the apartment should have been maintained in a safe and livable condition, and allegedly, it wasn’t.
The lawsuit outlines a long list of ways the situation disrupted the family’s life, stating: “[The] plaintiff experienced diminution in rental value, odor, separation from friends or family members, inability to sleep or eat in the unit, interference with life activities, and similar disruptions of one’s personal life.”
Suing Their Landlord
Now, the family is seeking compensation, including $2,600 in refunded rent and a much larger $122,000 in non-economic damages. The case will ultimately hinge on whether the property owner took appropriate action when the rodent issue was first reported.
